Nintendo Getting Sued for Joy-Con Drift Issues

A recent hardware issue in Nintendo Switch known as "Joy-Con Drift" leads to class action lawsuit against Nintendo.

After launching next-gen hybrid video game console Nintendo Switch back at 2017, Nintendo has been enjoying a pretty successful run until now, as they are about to get sued over a hardware issue known as "Joy-Con Drift".

On Friday, July 19, a U.S. law firm named Chimicles Schwartz Kriner & Donaldson-Smith has filed a class action lawsuit against Nintendo of America over claims and concerns from customers for a problem in Joy-Con controllers.

For months, Switch players are facing a problem with Joy-Con controllers where often times their console registers movement even though they are not touching the joystick and Nintendo didn't offer any permanent solution for it yet.

This issue could become apparent when someone is playing a game and player character suddenly starts moving without any input. It was originally registered in early stage of Switch life cycle and now is back again with no fix or whatsoever.

Switch owners have gone to various social platforms like Reddit and Twitter to voice concerns about drifting problem for a while and now many news outlets have joined them as well, leading to lawyers taking notice to the matter.

Since gameplay experience is often hindered because of drifting, CSK&D has stated that Switch controllers are deemed defective. They are currently asking Joy-Con drift affected users to submit details on an online form at their website.

An associate attorney at CSK&D, Andrew Ferich revealed their firm was reached out by more than over 5,500 consumers in 24 hours period regarding their trouble, which clearly violates consumer protection laws and they proceeded with a case.

Ferich also stated that they have been following this story of "Joy-Con Drift" for some time and they are well aware how gamers are very frustrated with this problem from various online conversations that caught their attention.

Initially, they didn't thought this to be a much bigger issue even if it has been bugging people out for some time but when 5,500 customers have riled up to them in a single day; they clearly knew that Joy-Con drift was a really big issue.

At this early point of case, it is really hard to determine what a winning situation would look like for CSK&D but they are planning to aggressively pursue a legal action so the best outcome for consumers can come out of their efforts.

Nintendo however, has been repairing Joy-Con controllers that falls under warranty but if a model is out of assurance period, users have no other choice than to purchase a new pair but even newer models are suffering from same problem.

Nintendo Switch has sold over 32 million units worldwide so far in its two years-long lifespan and they just announced a newer model as well as a revised version, Nintendo Switch Lite, currently scheduled to arrive on September 2019.

Given that these upcoming consoles share same Joy-Con design as original Switch, Joy-Con drift issue may continue over and the lawsuit can go bigger on them, leading to huge cost for Nintendo on top of negative press to ruin their reputation.
