Nintendo Sues ROM Sites for Copyright

Nintendo sued two ROM sites over copyright, leading one to shut down and another to pull all NES ROMs.

Japanese video game publisher Nintendo has recently filed lawsuit against two popular ROMs websites LoveRETRO.co and LoveROMS.com, both of whom were responsible for hosting some older console games from the company. Their reason to take legal action against these two sites was simply because of massive copyright infringement of their intellectual property rights. The former among them is already shut down while the latter took down all Nintendo files out of their directory.

Whereas this practice keeps the game alive among players for decades, it commercially robs the publisher of their revenue and despite knowing of it, most of them do nothing to stop it. Nintendo however, took a strong stand with this issue and filed a lawsuit in U.S. District Court for the District of Arizona on July 19 after frequently calling them out on occasion. Of course, many of these ROMs sites belongs to fans as some hobby projects but the two accused ones are definitely professional.

According to TorrentFreak, both of these sites were run by a same person who used to share old Nintendo game ROMs. These two sites were immensely popular online among others who host pirated video games. People who love to play games on their preferred platforms rather than a specific console they were created for uses these ROMs on various emulators to relive the experience. This comes in handy in case of countless retro games, which are no longer available in market.

Though, LoveRETRO.co couldn't be saved, LoveROMs posted this update on social media after removing all of their available ROMs on Nintendo games.

Apparently, these sites belong to Arizona based company Mathias Designs LLC and its owner Jacob Mathias, responsible for 140 copyright and 40 trademark breaches. Nintendo requested $150,000 for per infringement and $2,000,000 for each trademark violation, summing up a total of over $100 million for overall legislative damages. They also requested to court that domain names of these two sites should be handed over to them while also revealing sources for those pirated ROMs.
